互聯(lián)網(wǎng)平臺價格行為規(guī)則 rules to regulate pricing practices of internet platforms
為推動平臺經(jīng)濟創(chuàng)新和健康發(fā)展，近日，國家發(fā)展改革委、市場監(jiān)管總局、國家網(wǎng)信辦聯(lián)合發(fā)布《互聯(lián)網(wǎng)平臺價格行為規(guī)則》。
China has released new rules to regulate pricing practices of internet platforms, a move aimed at fostering innovation and promoting the sound development of the platform economy. The rules were jointly issued by the National Development and Reform Commission, the State Administration for Market Regulation, and the Cyberspace Administration of China.

為健全互聯(lián)網(wǎng)平臺常態(tài)化價格監(jiān)管機制，規(guī)范相關(guān)價格行為，保護消費者和經(jīng)營者合法權(quán)益，推動平臺經(jīng)濟創(chuàng)新和健康發(fā)展，國家發(fā)展改革委、市場監(jiān)管總局、國家網(wǎng)信辦制定了《互聯(lián)網(wǎng)平臺價格行為規(guī)則》（以下簡稱《行為規(guī)則》）并于2025年12月發(fā)布。本規(guī)則所稱平臺經(jīng)營者，是指提供網(wǎng)絡(luò)經(jīng)營場所、交易撮合、信息發(fā)布等平臺服務(wù)的法人或者非法人組織；平臺內(nèi)經(jīng)營者，是指通過平臺銷售商品或者提供服務(wù)的經(jīng)營者。本規(guī)則所稱價格行為，是指平臺經(jīng)營者、平臺內(nèi)經(jīng)營者在銷售商品或者提供服務(wù)過程中與價格相關(guān)的行為，包括制定或者變更價格、價格標示、收取費用、實施補貼等行為。價格包括商品價格和服務(wù)價格。
《行為規(guī)則》共計7章29條，規(guī)定了平臺經(jīng)營者、平臺內(nèi)經(jīng)營者實施價格行為應(yīng)當遵守的規(guī)范。主要內(nèi)容包括：規(guī)范價格競爭秩序，為平臺經(jīng)營者、平臺內(nèi)經(jīng)營者提供明確的價格行為指引；保護經(jīng)營者自主定價權(quán)，明確平臺經(jīng)營者不得對平臺內(nèi)經(jīng)營者的價格行為進行不合理限制或者附加不合理條件；保護消費者合法權(quán)益，落實明碼標價制度，推動動態(tài)定價、差別定價等規(guī)則公開，規(guī)范免密支付、自動續(xù)期、自動扣款等服務(wù)?！缎袨橐?guī)則》將于2026年4月10日起實施。

The implementation of anti-monopoly regulations and policies promoting fair competition is an intrinsic requirement for improving the socialist market economic system. Efforts should be made to foster a level playing field, create broad development space for all types of market entities and better protect the rights and interests of consumers in accordance with the strategic vision of fostering a new development paradigm, and promoting high-quality development and common prosperity.
